Just a year ago we knew that Spain would be the first country to create a controlled environment, also known as sandbox, artificial intelligence (AI). A sandbox It is a safe space that promotes experimentation and technology development, where providers can test services that, due to their degree of innovation, could not function normally in the market due to existing regulatory barriers.
In the specific case of AI, this environment will serve to verify the proper functioning of the requirements contemplated in the proposed regulation on artificial intelligence, approved on June 15 by an absolute majority by the European Parliament, and which will be the future application regulations in the EU.
It was recently when, finally, the draft of the royal decree that will regulate the sandbox. This document establishes the bases and requirements that Spanish companies must meet in order to participate in this controlled environment.
The fact that Spain is the country where this space is going to take place will not only give Spanish companies the opportunity to test in advance the future European regulations on AI, but it will also encourage them to verify irrefutably whether their technological developments are going to be able to operate and, therefore, be applicable within the market.
This space will be available to any legal entity that wishes to experiment with an artificial intelligence system in the testing process or with advanced development, whether it has been commercialized or not, as long as it meets the requirements established in the draft of the royal decree. One of the main purposes of the sandbox will be to identify the risks to which fundamental rights are exposed with the use of AI, which, once identified, will be transferred to the regulation creating the European regulations around them.
Therefore, all that remains is to wait for the final approval of the document on AI and for the period to present applications by companies that want to participate in this process to open. It will be then when the first results of how artificial intelligence will adapt to future regulations and what risks will be inherent in its use begin to be seen. In any case, Spain will be at the starting line, since it will be the conclusions and self-assessments of its national companies that will serve as a guide for future operations in other countries.
